Constitutionalism of Armenian President’s Decision to Join Customs Union

Arthur Sakounts and his associates will file a lawsuit to the Administrative Court litigating accordance of Serzh Sarkissian's act of announcement about joining the Customs Union to principles of democracy in Constitution. He didn't exclude that a lawsuit may be filed to the Constitutional Court later.

At the discussion held at the Media Center Sakounts mentioned that the documents of Eurasian economic union directly contradict to Article 1 of the RA Constitution, and Russia’s decisions will be obligatory for all the member-countries. 

Constitutional lawyer Armen Mazmanyan noted that only legal acts are litigated in the Constitutional Court, neither announcements nor actions. Mazmanyan encouraged the intention of taking a legal recourse. He advanced two possibilities of the claim to be satisfied: people’s support and authorities' wish. 

Head of “Rule of Right” NGO Artak Zeynalyan pointed out that the constitutionalism of the decision can be litigated in the regular court. 

On October 14 the Media Center hosted Chairman of “Rule of Right” NGO Artak Zeynalyan, Head of Vanadzor branch of Helsinki Citizen's Assembly Arthur Sakounts and constitutional lawyer Armen Mazmanyan.

The discussion was held within the series, “Armenia at the Crossroads of Development: Toward Europe or Russia?”, which includes public discussions, debates, and media events throughout the month of October, aimed at better understanding the implications of joining the Customs Union.
